1 Plaintiff in Error, Phillip Lee Carlile, hereinafter referred to as the defendant, was charged by Information with the crime of Illegal Possession of Barbiturates, Case No. CRM-70-133, in the District Court of Oklahoma County, Oklahoma. He was tried by a jury, found guilty, and his punishment assessed at One (1) Year in the county jail, and to pay a fine of $500.00. From that judgment and sentence, defendant has perfected a timely appeal to this Court.
