Order On order of the Court, the motion for immediate consideration is considered, and it is GRANTED. The application for leave to appeal is also considered and pursuant to MCR 7.302(F)(1), in lieu of granting leave to appeal, we REMAND this case to the Court of Appeals for consideration as on leave granted. The motion for stay is GRANTED, and trial of this matter is stayed pending the completion of the appeal of this matter. On its own motion or on motion of a party, the Court of Appeals may modify or set aside the stay if it appears that the appeal is not being prosecuted vigorously or if other good reasons appear.
