On August 16, 1970, Charles Mabra was found guilty by a jury of armed, masked robbery (secs. 943.32 (1) (b) and (2) and 946.62, Stats.) and of first-degree murder (sec. 940.01 (1) and (2)). The court sentenced him to life imprisonment for murder and an indeterminate term not exceeding thirty years for the robbery, the sentences to run concurrently. Within a year, Mabra moved for a new trial, which was heard and denied on November 23, 1971. Subsequently, on July 31, 1972, Mabra appealed from the judgment of conviction and the order denying the new trial. Pending appeal, he filed a motion to correct the record.
